These General Terms and Conditions of Sale (« GTC ») apply to all purchases made through the www.kreative-crafts.com website (« Website »). Please read them carefully before making a purchase, as they define the rights and obligations of both parties (the « Buyer » and Kreative Crafts, referred to as the « Seller ») in connection with the sale of products on the Website.

By placing an order on the Website, the Buyer agrees to be bound by these GTC. The Seller reserves the right to modify these GTC at any time, and the applicable version will be the one in effect at the time of the order. The GTC in force on the order date will remain applicable throughout the entire order process, from the order placement to the delivery of the products.

In case of any inconsistency between these GTC and any other document on the Website, including the Privacy Policy or the Cookie Policy the provisions of these GTC shall prevail.

Article 1. Products

All products offered for sale on the Website are described and presented with the greatest possible accuracy. The photographs and descriptions of the products are provided for information purposes only and may not be fully representative of the actual product. The Buyer is responsible for reading the product descriptions carefully and contacting the Seller for any additional information before placing an order. The Seller shall not be held liable for any errors or omissions in the product descriptions.

Article 2. Prices

All prices listed on the Website are in euros and are exclusive of French Value Added Tax (VAT), as Kreative Crafts operates under the Sole trader status (auto- entrepreneur) and does not charge VAT. The Seller reserves the right to modify product prices at any time without prior notice. However, the price applicable to an order will be the one in effect at the time of the order placement.

Shipping and handling fees are not included in the product prices and will be calculated and added to the order total during the checkout process.

Article 3. Contract Performance Procedures

3.1 Order Process: To place an order, the Buyer must follow the steps outlined on the Website, which include selecting the desired products, providing the required information, choosing a shipping method, and confirming payment details. The Buyer must ensure that the information provided during the order process is accurate and up-to-date. By placing an order, the Buyer agrees to the GTC.

3.2 Order Confirmation: Upon receiving the Buyer’s order, the Seller will send an email confirmation containing the order details, including the products ordered, the total price, and the estimated delivery date. The sales contract between the Buyer and the Seller is formed upon the Seller sending this confirmation email.

3.3 Payment: The Buyer must pay the total price of the order, including any applicable taxes and shipping fees, using one of the payment methods offered on the Website. The order will be processed once the payment is received and confirmed by the Seller. All payments are secure and made through trusted payment gateways. The Seller does not have access to the Buyer’s payment information.
Shipping and Delivery: The Seller will ship the ordered products to the shipping address provided by the Buyer during the order process. The delivery times and shipping fees will depend on the shipping method selected by the Buyer (when offered) and the destination of the delivery. The majority of products will be

shipped from Nepal, with a limited number originating from France. The Seller will endeavor to deliver the products within the estimated delivery times but cannot guarantee the exact delivery dates. The Buyer will be responsible for any customs fees, import duties, or taxes that may apply to the shipment, depending on the destination country. In the event of a delay in delivery, damage during transport, or non-delivery of the products, the Buyer must promptly notify the Seller, who will work to resolve the issue. »

Article 4. Right of Withdrawal and Return Policy

In accordance with French consumer law, the Buyer has the right to withdraw from the sales contract within 14 days from the date of receipt of the purchased products, without giving any reason. To exercise the right of withdrawal, the Buyer must inform the Seller of their decision by contacting them through the contact form available on the Website or by sending an email to info@kreative-crafts.com. Upon exercising the right of withdrawal, the Buyer must return the products in their original condition, securely packaged to prevent damage during transit, without undue delay and no later than 14 days from the date of notifying the Seller of their decision to withdraw. The Buyer will bear the direct cost of returning the products. The Buyer may choose to return the products either to France or to Nepal, whichever is most suitable for them.

Upon receiving the returned products, the Seller will evaluate the condition of the goods. A refund will only be granted if the products are found to be in their original, undamaged condition. The Seller reserves the right to refuse a refund or provide a partial refund based on the evaluation of the returned goods.

The Seller will refund the Buyer the full or partial purchase price, including any standard shipping fees, within 14 days of completing the evaluation of the returned products. Additional fees, such as expedited shipping, will not be refunded.

Article 5. Legal assurance of compliance and guarantee of hidden defects

The products sold on the Website are covered by a one-year warranty from the date of delivery, which guarantees conformity and protection against hidden defects in accordance with applicable French laws and regulations. The Seller will replace or repair any defective products or refund the purchase price, at its discretion, subject to the terms and conditions specified in the warranties. The warranty terms and conditions are as follows:

  • Warranty period: The warranty covers defects that appear within one year from the date of delivery of the product.
  • Warranty scope: The warranty covers defects in materials and workmanship of the products under normal use.
  • Warranty exclusions: The warranty does not cover damage resulting from improper use, accidents, modifications, unauthorized repairs, or normal wear and tear.
  • Warranty claims: To file a warranty claim, the Buyer must contact the Seller at info@kreative-crafts.com or through the contact form available on the Website, providing a description of the defect and any relevant evidence (e.g., photographs). The Seller will evaluate the claim and provide further instructions on how to proceed.

Article 6. Liability

The Seller’s liability for any claim related to an order, the products, or the use of the Website shall be limited to the amount paid by the Buyer for the products in question. The Seller shall not be held liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of revenue, profits, or data, arising from the use or inability to use the Website, the products, or the information contained therein.

Article 7. Intellectual Property

All intellectual property rights, including copyrights, trademarks, and designs, related to the products, the Website, and its content, are the exclusive property of the Seller or its licensors. Any unauthorized use, reproduction, or distribution of the protected content is strictly prohibited and may result in legal action.

Article 8. Personal Data

The Seller collects and processes the Buyer’s personal data in accordance with the Privacy Policy available on the Website, which includes information related to the use of cookies. By placing an order, the Buyer consents to the collection, use, and disclosure of their personal data as described in the Privacy Policy section on the Website.

Article 9. Force Majeure

The Seller shall not be held liable for any delay or failure in the performance of its obligations under these GTC if such delay or failure results from events, circumstances, or causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, or natural disasters.

Article 10. Dispute Resolution

These GTC are governed by and construed in accordance with the laws of France. In the event of any disputes arising from or related to these GTC, the sales contract, or the use of the Website, the Buyer is encouraged to contact the Seller first to seek a friendly resolution.

If the dispute cannot be resolved through direct communication with the Seller, the Buyer has the option to contact the European Online Dispute Resolution Platform (ODR) for assistance. The ODR can be accessed via the following link:

Should the dispute remain unresolved after utilizing the ODR platform, the matter shall be subject to the exclusive jurisdiction of the French courts. The relevant court for such disputes is:

Article 11. Miscellaneous

If any provision of these GTC is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
The failure of the Seller to enforce any provision of these GTC shall not be considered a waiver of its rights, and the Seller reserves the right to enforce such provision at any time.

These GTC, together with the Privacy Policy, Shipping Return Policy, and Cookies Policy, constitute the entire agreement between the Buyer and the Seller with respect to the use of the Website and the purchase of products, and supersede any prior agreements or understandings, whether written or oral.
